Website Terms of Service

These Website Terms of Service (the “Terms”) govern your use of texasnotaryandapostille.com (the “Site”) and the notarial and document services provided by StratElite Holdings, LLC, a Texas limited liability company doing business as Texas Notary & Apostille Group (“TNAG,” “we,” “us,” or “our”). By booking an appointment, submitting an order, or using the Site, you agree to these Terms. Apostille and document-authentication orders are additionally governed by our Apostille & Document Authentication Service Terms, refunds and cancellations by our Refund, Cancellation & Appointment Policy, and all personal data by our Privacy Policy; each is incorporated into these Terms by reference.
1. Who we are; scope of services
TNAG is a private document-services company. Depending on what you order, our services include: mobile and remote online notarization; certified loan and real-estate signing services; apostille and document authentication (governed by the separate Apostille & Document Authentication Service Terms); fingerprinting and biometrics; I-9 employment-eligibility verification; and related courier and logistics coordination. We are not a government agency and are not affiliated with or endorsed by any government authority.
2. Not a law firm; no legal advice
TNAG is not a law firm and does not provide legal advice, legal opinions, drafting, or representation, and no attorney-client relationship is created by your use of our services. A notary public is prohibited by law from advising you on which document to use, how to complete it, or its legal effect. If you need legal advice about your documents, their content, or their intended use, consult a licensed attorney in the relevant jurisdiction.
3. Notarial acts; limits imposed by law
Our notarial services are performed under Texas law. A notary’s fee for a notarial act is capped by Texas law (currently $10.00 per notarial act). Charges for other services — including travel and mobile service, after-hours or emergency service, witness provision, printing, and shipping — are separate services billed as posted, and are not the notarial fee.
We are required to verify the identity of each signer and to confirm the signer’s willingness and awareness. We cannot notarize incomplete documents, documents already signed where the signature must be witnessed by the notary, or documents for a signer who lacks valid identification, lacks capacity, or appears to be acting under duress. We may decline any notarization that the law does not permit, and doing so is not a breach of these Terms.
4. Booking, identity verification, and document submission
Payment is required to secure your appointment. Identity and document verification is required before we perform services; after you book, a secure link will follow with the steps to verify your identity and submit your document. You are responsible for bringing valid, unexpired, government-issued photo identification for every signer; the name on the identification must match the document. Do not sign or date your document until the notary directs you, as signing in advance can void the notarization.
5. Witnesses
Some documents require witnesses. Wills and many estate or financial documents require at least two (2) witnesses; check your document, which states its requirement. Witnesses must be neutral — they cannot be related to you or have any vested interest in the document or transaction — and each witness must present valid photo identification. By law, your notary cannot serve as a witness. You may bring your own qualified witnesses, or add our Witness Service and we will provide them for a fee.
6. Appointment time; additional time
Each appointment is allotted time based on the document type. If your documents require more time, additional documents, or added information, the extra time is billed at $25.00 per 15 minutes, and we will notify you before any additional charge applies.
7. Fees and payment
Fees are as posted on the Site at the time your order or booking is placed, and the posted amounts then in effect control. Government, consular, and other third-party fees are passed through and are non-refundable once incurred. Payments are handled by our third-party payment processor; we do not store full payment-card numbers.
8. Refunds, cancellations, and chargebacks
Refunds and cancellations are governed by our Refund, Cancellation & Appointment Policy, incorporated by reference. In summary: your fee reserves the notary’s time and travel and is earned on arrival; you may reschedule at least 24 hours ahead for a credit; and same-day cancellations, no-shows, and appointments that cannot be completed because required documents, valid identification, or correct information are not provided are non-refundable. By booking, you agree to these Terms and agree not to initiate chargebacks for services rendered or forfeited under this policy.
9. Remote online notarization (RON)
Where you order remote online notarization, the session is conducted under Texas law through a licensed online-notary platform, is recorded, and the electronic record is retained for the period Texas law requires. Our online notarial commission is administered through Williamson County, Texas. Personal and identity-verification data collected for RON is handled as described in our Privacy Policy.
10. Mobile and travel service
Mobile service is offered by travel zones as posted. Travel and zone fees apply in addition to service fees and are non-refundable once the notary is en route to your location.
11. Third-party services
Certain services depend on independent third parties, each governed by its own terms: scheduling and payment processing; identity-proofing and credential-analysis providers; the remote online notarization platform; and shipping and courier services. Return delivery, if elected, may be arranged through Pak Mail of Cedar Park, a separately owned and operated business; that shipment is a separate service under that business’s own terms, rates, and insurance options, and TNAG is not the shipper and is not liable for loss, damage, or delay in transit.
12. Acceptable use of the Site
You agree to use the Site only for lawful purposes, not to submit false or fraudulent information, and not to interfere with the Site’s operation or security. We may suspend or refuse service for misuse.
13. Intellectual property
The Site and its content, including the Texas Notary & Apostille Group name and logo, are owned by StratElite Holdings, LLC or its licensors and are protected by law. You may not copy, reproduce, or use our marks or content without our written permission.
14. No guarantee of acceptance
We do not guarantee that any notarized, apostilled, authenticated, or otherwise completed document will be accepted by any receiving party, institution, court, or government. You are solely responsible for confirming the receiving party’s requirements before ordering.
15. Disclaimers and limitation of liability
Services and the Site are provided “as is” to the maximum extent permitted by law. To the maximum extent permitted by law, TNAG’s total aggregate liability arising out of or relating to these Terms or the services, regardless of the theory of liability, shall not exceed One Hundred Dollars ($100.00) or the amount of the TNAG service fee actually paid for the affected order, whichever is greater. TNAG shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits or damages from missed deadlines, document rejection, non-acceptance, or third-party delay. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to indemnify and hold harmless TNAG, StratElite Holdings, LLC, and their members, managers, employees, and agents from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your documents, the use to which completed documents are put, your breach of these Terms, or any inaccurate or fraudulent information you provide.
17. Electronic records and signatures
You consent to transact electronically. These Terms and related documents may be presented and signed electronically, and electronic signatures and records are valid and enforceable to the same extent as handwritten signatures and paper records under the federal ESIGN Act and the Texas Uniform Electronic Transactions Act. You may request a paper copy and may withdraw consent by written notice, though doing so may delay or prevent our provision of services.
18. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the services shall be the state courts located in Williamson County, Texas, and the parties consent to the jurisdiction of those courts.
19. Changes; entire agreement; general
We may update these Terms prospectively by posting a revised version; the version in effect when your order or booking is placed governs that order. These Terms, together with the incorporated policies and your order details, constitute the entire agreement regarding the services. If any provision is held unenforceable, the remainder remains in effect. Failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization or transfer of the business. We are not liable for delay or failure to perform due to causes beyond our reasonable control.

21. Text Message Communications
By providing your mobile number and checking the SMS consent box on our scheduling form, you agree to receive appointment reminders, service updates, and account-related text messages from Texas Notary & Apostille Group, including messages sent using an autodialer. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance. Carriers are not liable for delayed or undelivered messages.
